I owe all of you some catch-up posts. In the last year and a half, my husband and I decided to move to a more rural environment, found a house (and bought it), moved, sold our old house, dealt with a death in the family that was a long time coming, tried to settle in to our new country-ish lives while wildfires raged in the Sierras last summer, and adopted a Queensland Heeler/McNab Border Collie puppy. So, you know, the usual.
In late January/early February of this year, we really got walloped when I had a major health scare and ended up in the ER/OR/Hospital for a few days. When I came home, Ron and I agreed that the phrase, "when things calm down" would be stricken from our vocabularies because you can never really count on life to calm down. After a few weeks of difficult recovery, I realized I also needed to make some changes to my life and business. You can read the hospital story and find out what changes I'm making to Krissi's Art Studio/Skelekitty & Friends at the newly designed krissisandvik.com.
I went looking through a supply shelf the other day and found several of these awesome 10" high Hydrostone sacred hearts, so they're officially available in the online shop again!

Cesco's Muertos since 2009. Cesco pours each Hydrostone heart, using his own handmade molds (created from his original sculpture, of course!). Hydrostone is a mix of cement and plaster, so it is much stronger and harder than plain casting plaster.

It's Autumn, and that means it's time for everyone I know in the art/DIY world to switch out of Con Mode and into Holiday Mode. Yes, it seems early for Christmas, but every November I have to turn frantic last-minute customers away, which makes me very sad. It's not that I don't WANT to create a custom gift for you, it's that my technique takes time (especially in cold, damp weather). Add to that the fact that there are about 10 others begging me to "just do one" for them, and you see the problem.

Scroll down for Thanksgiving sale info and holiday order deadlines. <strike> In the meantime, I'm trying to entice you all into ordering a little earlier this year; therefore, I offer you an early bird sale.</strike>

<strike>
EARLY BIRD SALE</strike>

<strike>
I am giving an unheard of 15% discount to folks who order custom paintings/boxes early! Now through September 30, all custom work is 15% off. These items will not be on sale over Thanksgiving weekend (which is past the custom order deadlines listed below anyway), so don't wait!</strike>
These dates may be changed as my schedule fills up. The more orders I have, the earlier the deadlines become. Those who order first will receive first priority.

THANKSGIVING WEEKEND SALE

As T-Day sale details are refined, I will be updating information on this post, as well as on my social media pages and skelekitty.com. In the meantime, here's what I have decided:

The sale will last for 4-days over the Thanksgiving weekend (Friday - Monday night)

All ready-to-ship paintings, jewelry, trinket boxes and prints will be on sale. (Custom items will NOT be on sale, and the "add to cart" button will be deactivated on custom items during the sale, to prevent people from ordering customs erroneously.)

Coupon codes will be provided for the sale and cannot be combined.

I am happy to combine shipping on separate orders placed over the weekend, and will automatically refund extra shipping charges.

Since custom art and boxes will not be on sale, I strongly recommend that you get your custom order in now. Just take advantage of the early bird sale, why don't ya?

One more VERY important note

Please check your browser's compatibility with my shop, skelekitty.com.

Over 95% of my customers fly through the shopping process with no problems, but occasionally someone has an issue. Why? The system on which skelekitty.com runs, (Goodsie.com) no longer supports some older browsers including, but not limited to Safari 4 and Internet Explorer 8. Updating your browser or switching to a different browser altogether may resolve your issues.

Have you updated Internet Explorer but are still seeing a blank page?
Look for the blue compatibility issues icon and click on it.

If you are using the current browser version (Chrome and Firefox are recommended), but continue to have problems, please contact me with your OS/browser/version and details and I'll forward the information to Goodsie.

I am happy to send PayPal invoices, however, please note that absolutely no invoices will be sent during the Thanksgiving weekend sale.

Please don't wait for the order deadline or Thanksgiving sale only to determine that your firewall or browser version/settings block my site. Seriously. Please don't wait for Thanksgiving, since I'll be out of town with no internet connection. You'll miss out on the sales, and we will both be sad.

* order = payment and all requirements. Your order must be completed, including work requirements, by September 30th to qualify for sale. Paid orders without requirements will be refunded on October 1.

Why, you ask? Well, I've actually been creating new things in the studio, which is always a good thing.

Last November, I officially reintroduced the Krissi's Art Studio trinket boxes for the Dia de los Muertos show I did at Little Relics in Sacramento. Since then, I've introduced multiple sizes and new designs, and people have responded by requesting plenty of commissioned boxes. Here are a few of the new pieces I've been working on since February or so:

(new landing page at skelekitty.com)I spent two full days this week working on making my shop easier for folks to get around in. There are two big changes that I think are pretty cool:

New main page. Instead of the old main page, which took you to the first 20 or so products, now you will start at this awesome page, where you can browse by item (paintings, earrings) or imagery (hearts, Doctor Who, etc.) It looks like this:

NEW skelekitty.com main page helps you browse items using pictures

As you can see, all the text links are still available on the left nav bar, but now you can browse visually, and easily find imagery (previously these categories could only be accessed from a pull-down menu on the ALL THE THINGS page). If you ever want to return to this page, just click the shop banner and it will take you right there.

Links inside listings. Let's say you are clicking around and come across a pendant you like, but you don't wear jewelry, so you wonder, "is this available as a print?" Now all you have to do is scroll to the bottom of that listing and click SEE ALL ITEMS WITH THIS IMAGE (it's right above the price). Clicking that link from inside any listing will show you all items with the same image or group of images. In the rare case that there is no link, it means that the item is unique or is not yet offered on other items.

I'm always looking for ways to make shop browsing easier for customers, so if you ever have a question or suggestion, drop me a note using the contact link in my shop.

Thanks for dropping by!Krissihttp://www.blogger.com/profile/16305036914149458037noreply@blogger.com0tag:blogger.com,1999:blog-8080818212847870026.post-52651864381044567782013-04-08T10:55:00.000-07:002013-04-08T10:56:34.404-07:00Spring Forward In Time - Timey Wimey Piece and Print of the WeekIt's Monday, and that means it's time for a new Print of the Week (and it's early since I'm not catching up on last night's episode of a show my husband won't watch). But first...

Timey Wimey Weeping Angel
pendant with watch gears

I was going through my supply stash recently and came across some Nunn Design 1" bezels I purchased at an expo a few years back. I was doing a run of glass and resin pendants anyway, so I thought it would be a perfect time to do some resin layering in one of the bezels.

But which image should I use and what stuff should I layer in there?

We learned in the Doctor Who episode Blink that the Weeping Angels use time to "kill you nicely. No mess, no fuss. They just zap you into the past and let you live to death." Then they feed off all of your life's stolen moments. So yeah, it seemed obvious: one of my Weeping Angel paintings + timey wimey stuff (gears) = awesome. I made one of these to see how you guys like them, but if I make more, each would be slightly different (and yes, of course you can get one custom made with a different Weeping Angel).

Sage Bee 8x10" print

Moving on to something a bit lighter (but wait! We "lost" an hour recently! Was it the Weeping Angels or daylight saving time?) It's definitely feeling like here, which means sunshine, sneezing, blossoms and bees! I'm celebrating the return of the honeybees by putting the Sage Bee print up as Print of the Week. Sage Bee was one of the paintings I did for the Spring "Out There" nature-themed art show last April.

You know the deal by now: the 8x10's are 50% off (only $7.25), you don't need a coupon code, and the sale is good all week (I switch them out mid-day on Mondays). You can always find the Print of the Week by clicking the link in my shop, or find all the sale items by clicking on OMG, ON SALE!!! (and I added some more pendants to the sale/clearance section last week!).

Maybe it's because The Venture Bros. is finally coming back with Season 5. Honestly, who's to say? Either way, you can have 8x10s of either Soul Searching or Spirits' Journey for half off this week (a limited number of 11x14s are also available and also on sale).
The answer to the first is "pop culture, life, music and my 'black comedy' sense of humor." While that is definitely true, it is also pretty vague, so I thought I'd start occasional posts that tell the stories behind and beyond some of my pieces. Of course, sometimes, a painting is just a painting, so not all of my images will show up in this series.

COURAGE (2008)

pyrography, acrylics and mixed-media on wood

This panel was 1/9th of a collaborative piece gifted to a friend in early 2009

In late 2008, a friend and fellow Sacramento artist, Kathy Blackburn and her musician hubby Byron, learned that his cancer had returned the day before his 1-year remission anniversary. Out of love and concern, nine Sacramento artists collaborated on a piece to wish Kathy & Byron "Love, Happiness, Strength, Courage, Positivity, Hope, Friendship, Support and Peace."

I agreed to be part of the collaborative gift before I knew what we were actually doing. I'm a sucker like that. So when I received the huge panel, I sat staring at it wondering what the heck I was going to do with the either "courage" or "happiness," which were the remaining words from which I could choose. I wasn't feeling much inspiration; mostly, I was just feeling stress. I set the piece against the wall and went to work on other things.

Meanwhile, I was taking several online courses (I switched from art quilts to painting/mixed media late in 2007). About the same time I'd agreed to take part in the Blackburn piece, I was taking part in an 'oracle card' art challenge even though I had absolutely NO idea what the heck and oracle card was. We were supposed to make something that represented a positive force in our lives - something that was representative of what was going on. I turned to my friend and resource for all things occult/pagan, Temple Terkildsen, for a primer. She pretty much told me to chill and just see what kept coming up in my life and that would decide what my "oracle card" should be. Whatever. I went back to the collaborative painting and stared.

In desperation, I looked up the definition for happiness and courage, and that's when I saw that the word comes from the Latin "cor" meaning "heart."

Courage: c. 1300, from Old French corage, from Vulgar Latin Coraticum from Latin cor, "heart," which remains a common metaphor for inner strength.

By this time in my art career, I was pretty well known by that point for creating hearts, so it was painfully obvious which of the panels I'd be doing (and that it would also be the oracle card project).

So, the heart image is for courage, the thorny branches for the difficult things in life and the flowers are for hope. The text on the lower, left corner is the definition (above) and the quotation in the top, right corner is a quotation from Osho, someone whose work Temple suggested I look into while trying to work on my oracle card challenge (more crossover between the projects). The quotation reads,

Don't cling to any certainty. Life is uncertain - its very nature is uncertain. And an intelligent man always remains uncertain. This very readiness to remain in uncertainty is courage.

I totally get it. That's why I've made magnets and key chains just for the folks who prefer to walk around unadorned.

MAGNETS!!!

Yep. Magnets! After years of begging from fans, I started making sets out of the obvious collections: the sugar silly skullies and my take on the Weeping Angels. So far, the sugar silly skullies have been the runaway hit. No surprise there - look at those cute and colorful faces!

The 1" glass tile magnets of all five sugar silly skullies have quite a fan base!

These magnets are made with the same one-inch square glass tiles, silicon-based glue, sealant and techniques as my jewelry, except that I don't seal the back sides with resin. Since these will be sitting quietly on your fridge or magnetic white board, they don't need protection from cosmetics, perspiration and the perils of daily life (one customer's toddler dragged the garden hose into the living room and squirted her while she was wearing a pendant - you just never know what might happen).

Since I know not all my customers are Doctor Who fans or dig sugar skulls as much as I do, so I also offer create-your-own sets of magnets.

KEY CHAINS / ZIPPER PULLS

In addition to the magnets, I've added a key chain option to the 1" tiles. This option is only available on the small tiles, which are sturdier and more likely to stand up to the abuse a key chain or backpack zipper pull will encounter on a daily basis.

Ordering a key chain is easy. Just 1) find the listing for the image you want (they're alphabetical by title or you can use the search box at the bottom of the nav bar), 2) choose the 1x1" size (ready-to-ship, if it's available, is always $2 less!), then 3) check the box for "key chain option."That's it!

If I have posted a new image that isn't in the shop as a pendant yet, you can use the customized key chain listing and request the image you like.

So there you have it. Magnets and key chains. Apparently, if you bug me for long enough about offering certain options, I'll actually do it. So, you know, thanks for the continuous nudging, folks.

Venture Bros. and Doctor Who ReturnThe most recent Doctor Who mid-season hiatus, while nowhere NEAR as long and tortuous as the two and a half year break between Seasons 4 and the "bright and mother f#@&ing cheery" Season 5 of The Venture Bros., is still as keenly felt for those of us who breathe geekery like it was air. 'Cause it kinda is.
With Season 7.5 of Doctor Who premiering at the end of the month, we can begin to sate ourselves with more of the Doctor's new mysterious companion, freak out at some new and returning creatures, ooh and ahh at more writing from Neil Gaiman, and thrill at an appearance from the amazing Dame Diana Rigg!
I'm not entirely sure what to expect with Season 5 of The Venture Bros (which airs at midnight on May 19th), but between the preview video and some screen caps on Jackson Publick's blog, I understand we'll see the boys continuing to grow up, a giant crustacean, more of Shallow Gravy (the band), a pterodactyl, a skinny-dipping Doc, and The Monarch in various costumes (including his jim-jams).

Because I'm a dork and new seasons of these particular shows excite me even more than the longer days and warmth of Spring, I'm celebrating with a sale of all things Doctor Who and Venture Bros!
This week's POTW is the Golden Poppies from my Art Nouveau/Arts & Crafts Flowers series. The 8x10s" are marked down 50%, from $14.49 to only $7.25. The 11x14" sizes are available for $14.25 (regularly $21.49).
For those of you new to POTW, I got the idea from the indie makeup companies that offer a different one of their colors at a discounted price each week or month (Color of the Week/Month). The idea is that every week, a different one of my prints will be massively on sale. Here's how I see it working out:

Sale is from Monday at lunchtime to following Monday at lunchtime

No coupon needed, it's marked down already

50% off 8x10" prints and more than 30% off 11x14" prints

No limit - get as many as you like

I'll decide which prints go up, BUT I will make that decision based on fan/client input

Images will not be POTW more than once in a 6 month period, so snap up your favorite when it comes around

You can find the POTW by clicking on the Print of the Week link from my site (or click the SALE link to see everything that's been marked down).

Occasionally, I'll put a pair of prints on sale (because I'm nuts)

Check back next Monday (just click on the "Print of the Week" link in my shop) to see which print will be on sale. I will switch them up around lunchtime here in California.

And of course, let me know which image you would like to see as Print Of The Week!

I know a lot of you have read my "not-really-a-tutorial" on how I make my pendants because I've gotten some great feedback from you. As an addendum, here's a tip/trick for when good pours go bad (and how I fix them).

Sometimes, no matter how careful I am, some resin will spill over the edge of my glass tile and adhere to the front.

You can see where the resin spilled over the edge and onto the
front of this glass tile (which will be an art pendant for my friend Jenn!)

If the spillover is thick enough, it can be peeled off cleanly and with relative ease after about 12 hours of curing time (the resin will be dry, but still pliable). If only a tiny amount of resin has gotten on the front of the glass, it leaves a cloudy residue that doesn't peel up.

Don't use anything abrasive - it might scratch or damage the glass tile. Do this instead:

Rubbing alcohol is your friend when you're working with sticky resin!

Soak a cotton pad, folded paper towel or rag with rubbing (isopropyl 70 or 90%) alcohol

Set the tile face-down into the soaked pad and allow it to sit for a few minutes

Gently rub the surface with a paper towel to remove the softened resin (if you notice the resin isn't dissolving, add more alcohol to your pad and start over)

Be very careful not to get alcohol onto the finished resin coating the back, and only hold the tile by the edges so you don't press fingerprints into the resin which still may be soft

With some patience, the alcohol, and some gentle rubbing with your fingernails and the paper towel, the unwanted residue will come right off the glass.

Now the glass tile is so shiny, you can see my
yard reflected in it. Yay!

The resin on the back needs to cure for another 12-72
hours, and then I can add a bail and ship the pendant

Magnets: These little guys are an inexpensive way to collect Krissi's Art Studio/Skelekitty images. I use the same sturdy glass 1" tiles (the ones in my personal collection have survived many a drop onto my ceramic tile floors), but keep the price down by sealing them with a silicone product instead of the 2-part jewelers resin I use on the jewelry. You can purchase sets I have put together or choose the images yourself. Click here to see all magnet sets.

Key chains: Because some people don't wear jewelry but still want a piece of art to carry with them every day, I do offer my 1" glass tile and resin pendant pieces as key chains. The tiles are created and sealed with 2-part jewelry grade resin, just like my pendants are, but instead of a pendant bail and chain, you receive a low-profile bail with an attached spring-clasp key chain. The spring latch key chains are nickel plated and measure approximately 1" wide by 2.25" long (including loop and snake style chain, a little over 3" with 1" tile).

Coupling Failed with key chain and low-profile bail
option may be added from pendant listings by choosing
"key chain" option instead of sterling-plated ball chain

Any 1" pendant can be made into a key chain (2" glass tiles are heavier and less sturdy, and are therefore not recommended for key chains). There are two ways to order: either go to the "customized key chain" listing and choose your desired image, or go to the pendant listing for the image you like and choose the "key chain option" at the bottom (the second way seems less intuitive, but can save you a few bucks if a 1" pendant tile is ready to ship - if you order through the custom listing, a new tile will be made for you).

Earrings: YES! Earrings are now available to go with your pendants or to be worn on their own. They're tiny -just 5/8" of an inch- simple images turn out the best. I welcome mix & match sets (like Skelekitty angel/devil or the pair of crazy-eyed owls). I lived through the 80s - I won't judge if your earrings aren't matchy-matchy. See all earring listings here.

Rainbow Silly Skully earrings

One of the cool things I've been doing with earrings is taking a detail from a painting -say a fish from the mermaid painting Something's Fishy- and making it a focal point for an earring/pendant set. Of course, if you just wanted the little fish earrings, I'd be OK with that too.

Something's Fishy pendant with the fish detail on earrings
pendant / earrings also available separately

If you decide you do want a matched set, you save a chunk of cash by buying the pendant with your earrings. Just scroll down and choose the "add a matching pendant" option. You'll notice the prices for pendants added to earrings are quite a bit less than if you buy them separately.

As of 2/20/13, I've dropped the prices on several items:

Earrings: Custom earrings have dropped in price from $28 to $26 a pair. Ready-to-ship earrings, of which I have several pairs to be listed this week, will be only $24/pair. Even though I've reduced the price on the earrings, I still use the same products and techniques on these that I do on my pendants, to ensure that you have jewelry that will last.

Prints: I have also reduced my regular 8x10" print prices from $15.99 to $14.49. This isn't a sale price - that's where they're going to stay. That means that the featured Prints Of The Week will be just $7.25! Be sure to check in every Monday afternoon at skelekitty.com (or on the facebook page) to see what the current print of the week is. Don't miss your favorite image when it comes around!

Pendants: Those of you who don't need a chain with every order will be happy to hear that chains are now an option on all pendant purchases, so you'll save a few bucks here and there. The price of a 1x1" ready-to-ship pendant has dropped from $21.95 to $19.99, and you may add a 24" sterling-plated, small gauge ball chain to your order for just $1.95. Here's how:

We hope these minor adjustments will help your wallets a little here and there!

Best wishes,

What's a "Print of the Week?" (POTW) you ask. Well, I'll tell you. I got the idea from the indie makeup companies that offer a different one of their colors at a discounted price each week or month (Color of the Week/Month). The idea is that every week, a different one of my prints will be massively on sale. Here's how I see it working out:

Sale is from Monday at lunchtime to following Monday at lunchtime

No coupon needed, it's marked down already

50% off 8x10" prints and about 35% off 11x14" prints

No limit - get as many as you like

I'll decide which prints go up, BUT I will make that decision based on fan/client input

Images will not be POTW more than once in a 6 month period, so snap up your favorite when it comes around

You can find the POTW by clicking on the Print of the Week link from my site (or click the SALE link to see everything that's been marked down).

Occasionally, I'll put a pair of prints on sale (because I'm nuts)

The first Print of the Week (POTW) is Griding To A Halt. The 8x10" is marked down 50%, from $14.99 to only $7.50. The 11x14" sizes are also $7.50 off (that is about a 35% savings).

Howdy folks! Well, here we are in the second month of the new Skelekitty.com shop. So far, so good! How about some sales, hmm?

Valentine's Sale [link to sale items]

Everything with "love" in the title or that features hearts or flowers (not just roses!) as a central image are on sale though the end of Valentine's weekend (Sunday, February 17). No coupon is needed since everything is already marked down for you. I'm awesome like that.

shhh. Don't tell anyone, but I seriously dislike this holiday. However, I love flowers, hearts and buying stuff for myself - when it's on sale it's even better!

BOGO Print Sale [link to prints]

I haven't done one of these in a while, so why not now? All 8x10" prints are Buy-One, Get One Free through Sunday, February 17th, too!

Here are the instructions and "fine print:"

BOGO sale applies to 8x10" prints only (does not apply to hand-painted mats, 11x14" prints or print sets).

No coupon needed! Leave a note in the PayPal "notes to seller" saying which 8x10" print you would like as your free print. (Not using my preferred method of PayPal? If your payment method doesn't allow for a "note to seller," please send me an e-mail with all the necessary information for me to connect it to your purchase.)

There's no limit. If you buy two prints, you can choose two free prints. If you buy four, you get four.

You may double up on your prints and give the extra as a gift or mix and match and keep them all for yourself!

Free prints must be the same or lower price than the purchased print. (You may not pay for a sale print and choose a full priced print as your freebie because, c'mon... I need to pay for my supplies, after all!)

RED KITTY WITH A PINK TAIL (2012)

people sometimes refer to this painting as "Joyce's Alzheimer's kitty"

In the summer of 2012, my mother-in-law, Joyce, was officially diagnosed with advanced Alzheimer's Dementia. It had been coming on for almost a decade of forgetting, arguing and battling until she was diagnosed in late 2011. Things finally got so bad that she was hospitalized in the summer of 2012. While in the hospital, she insisted she saw a "red kitty with a pink tail." She said the kitty had been coming in and out of her hospital room and asked my husband where she had gone. He was educated enough about the disease to know telling her there was no kitty wouldn't help, so instead he asked her about it. Joyce said that she was a "nice kitty" and when asked what the kitty was doing, Joyce replied, "Oh, you know. Kitty things."

My husband is convinced, because of my hair color at the time (crayola red, which had previously been magenta) that her brain turned "Krissi," into "kitty" and she was really talking about me. After all, I had been in and out of the room for several hours.

The facility where she now lives promotes the idea of "going on the journey" with the Alzheimer's patients, so we continue to ask her about whatever she experiences on any given day. The conversations have been interesting, and other "kitties" have come to visit her, but the jewel-toned Red Kitty never returned.

I met Potsdam, NY painter, photographer and ceramics artist, Sara Lynch, when I first joined Google+ last year (you can add Sara to your circles - and me too). It was love at first ... whatever we call it here on the world wide interwebs. She was funny, sarcastic, friendly and creative and, while I keep it off most of my official fan pages, she also swears like a longshoreman (just like me). Because I also kept active on Facebook, I immediately stalked her over there and then went looking for her online shops. What I found was something I'd been wanting for a long time - a pie bird. But not just any old pie bird, a HANDMADE, ZOMBIE pie bird, complete with little "x"s for eyes! I ordered two (and a little yellow birdie shot glass).

but he's bursting through a heart.
Mmmmm....

Not only did the pie bird do what it was supposed to (that is, it vented steam from the pie to prevent cracking and distortion of the crust), but it looks great on my shelf as a knick-knack when I'm not baking. Also, for the record, there is absolutely nothing as cool as bringing a pie to a party that has a zombie bird poking its way out of the center. Nothing.
Since I don't (currently) have anything zombie-themed in my shop to go with this, I briefly thought about doing birds, but decided to go the ironic baked goods route instead. Kenzie Jardina, creator of the Ruggle security blanket and Bewhiskered blankets has been a fixture in the DIY scene for some time. She started making Ruggles when she had her first son, several years back - she initially wanted a baby rug with personality, but then wanted something a little more portable and toddler friendly as he started to grow up. The very first Ruggle (a tiger) was born! Even though I don't have kids of my own, I've known about Bewhiskered through the DIY community (we're a tight-knit bunch) and through my friends who do have kids. Recently though, I started thinking about getting a Ruggle for myself (realizing, of course, that either the cats or my Jack Russell Terrier, Abby, would ultimately take possession of it). Did you, my geeky commrades, know that she makes a line of Ruggles that are strictly mythical creatures? In today's world, we all need a little extra feeling of security, wouldn't you say?

Her navy blue eyes are appliqued on and are also fleece. Her body contains quilt batting and her head is stuffed with fiberfill and can be used as a small pillow (or as a full pillow for a small head). She measures approximately 17" across and is 35" from the tip of her snout to the end of her tail.

I haven't been here to talk about intellectual property (copyrights, etc.) for a while, so I guess it's about time to talk about what rights, if any, a customer has to keep a design/item exclusive. That is, can they expect an artist not to make the same piece again. I spoke to these issues a little in my "Can I Use That Image?" and "You Stole My Idea! ... or did you?" posts, but the subject has come up several times in recent weeks on a few of the social media forums I frequent, so I thought some clarification was in order.

Let me take a moment to remind you all that I am not a lawyer. I worked as an intellectual property analyst and licensing contract writer/negotiator for years, so I know just enough information to be dangerous. This post does not provide all possible details or exceptions and DOES NOT constitute legal advice. If you need advice, CONTACT A QUALIFIED ATTORNEY.

Exclusivity Rights. In short, customers are not entitled to an expectation of exclusivity when they purchase a handmade item or piece of artwork. The exception* would be if the customer had a written contract from the owner of the intellectual property rights and the creator of the item (might not be the same person/entity) stating that the design, image, specific item, combination of materials, etc. would never be created or sold again. It is generally unrealistic to expect most artists to agree to exclusivity, since licensing and viral marketing can be our bread and butter. However, for those who think they can get this agreement from an artist, be sure to make your request before you pay and work begins.

"But what about..."

Custom creations. A customer does not have the right to limit reproductions (prints, etc.) or recreations of a custom item. Even if a client gives an artist "the idea," the resulting work/design/image belongs to the artist. A potential client once asked me to paint a specific animal in my Skelekitty & Friends style, and then referred to the custom order as a "collaboration." Since he did not pursue the order for other reasons, the issue was never discussed between us, but it can be important to make sure clients understand a bit about the rights retained by an artist (easy to do with an image/design rights notice on order sites and on a note with the delivery).

A few weeks back, an artisan publicly posted on a public forum that they had "obtained permission from the client" to reproduce one of his own creations. I immediately saw this statement as a dangerous reinforcement of the erroneous belief so many customers have: the belief that they own the image/idea when they purchase an item. After speaking with the artist about intellectual property rights, I learned that he didn't "get permission" from the client as much as he asked them if they'd mind if he made more. (He typically made one of each project, but reproductions of this item were in high demand after it was posted it online.) So while the artist didn't technically have to ask the client if they thought it was OK for him to make more, it was definitely a good business move since communication like this develops and preserves existing and future relationships. (It's the kind of relationship building Weird Al does when he asks for permission to use a song before he does a parody, even though he doesn't legally need to do so, much to the chagrin of Coolio. He asks because he respects the feelings of the original musician, not because the law requires it.)

Items marketed as "one of a kind." Does "one of a kind" count as a written guarantee from the creator that nobody will ever have a similar item? Nope. Even if an item was marketed as limited or one of a kind, the artisan is not guaranteeing that they will not make a substantially similar item in the future. I know, I hear some of you out there saying "but it said ONE of a kind! That means it will never be made again!" Not really. Why? It's nearly impossible to mass produce identical products by hand. The very nature of handmade items makes each piece, even if they're all identical in design, one of a kind.

How about I give you some concrete examples while I tell you about some super awesome art my friends make?

Let's say we have a ceramicist who makes, oh, let's say, zombie pie birds (which are so awesome that I have two of them!) Many of these pie vents are made using the same design and glazes, but because they are all individually hand made -no molds- they are in fact each one of a kind.

Every pie bird in this family is one of a kind!

Similarly, I have a friend who makes bottles with etched skulls on them. However, because she draws and cuts every single-use stencil by hand, each bottle is considered one of a kind - even though she might make 10 or even 100 of them.

Each hand-etched bottle by KitCameo is different because
her hand-drawn and cut stencils are used one time only

So let's move away from the whole idea of legal rights and limiting factors and talk about why you want to buy custom work if a few people might end up with an item like yours.

You are getting exactly what you want by ordering a custom, handmade item. You never have to settle and the possibilities are endless.

Artisans take their craft very seriously and these items are made with love and are of very high quality (yes, there are 'bad sellers' out there, so do some research but keep in mind that even the best sellers may have one or two irrationally angry buyers floating around).

You learn about the creative element as it happens, and often get a chance to give input as your item as it is being created. That's just cool.

Compliments! People are really becoming interested in buying handmade and custom art and items draw attention to you. Plus: you get to help out an artist by spreading the good word!

Bragging rights: you can brag that you were the first person to ask for this item/request this custom or that it's your dog someone painted, etc., etc., etc.. People dig your style!

and mostly

Because, assuming being an individual is so important to you that you demand a completely unique item, only one or two people in hundreds of millions might have something kinda sorta like yours. And why would you want to damage a business you are supposed to be supporting? That's what you are doing by asking some of them never to sell 'your' awesome item again.

Thanks for reading. I hope this helps to clarify some more of the fuzzy areas of intellectual property that affect the handmade community and our clients. I'll continue to write these articles as I see problems, disagreements and confusion around teh interwebz.

===============================================================
* as usual, I am not taking "work for hire" into consideration. If you want to know every possible nuance surrounding these subjects, I suggest you consult an intellectual property attorney, or perhaps consider applying to law school yourself.Krissihttp://www.blogger.com/profile/16305036914149458037noreply@blogger.com2
